This act gives local jusitces the power to issue Subpoenas as Clerks of the Peace when enforcing " An Act to repeal all the Acts regulating Tavern Keepers and Retailers, and to make other provisions in lieu thereof."
This act provides for the erection of a new jail in Saint John, specifying how finances are to be collected and assessed for the building of this jail, who is responsible for determining rates and assessments, and procedures for the appointment of commissioners for the jail once it is completed.
This Ordinance makes provision for the appointment of a Commissioner of the Inferior Term of the Court of King’s Bench for the District of Montreal who is to sit and act as judge in certain cases. The salary and powers vested in the Commissioner are outlined.
This Ordinance makes provision for the evaluation and transfer of the property of the lot provided for the construction of a jail in Montreal under the 1805 Act, “An Act to provide for the erecting of a Common Gaol in each of the Districts of Quebec and Montreal respectively, and the means for defraying the expenses thereof.”
This Ordinance makes provision for the erection of court houses and jails in districts where the District Court is to be held but no court house or jail currently exists.
This Ordinance amends the 1840 Ordinance passed earlier in this Session, "An Ordinance to amend a certain Ordinance of the Legislature of this Province, made and passed in the fourth year of the Reign of Her Majesty, intituled, 'An Ordinance to establish new Territorial Divisions of Lower Canada, and to alter and amend the Judicature, and provide for the better and more efficient administration of Justice throughout this Province;' and also a certain other Ordinance of the same Legislature, made and passed in the same year, intituled, 'An Ordinance to provide for the more easy and expeditious administration of Justice, in civil causes and matters involving small pecuniary value and interest, throughout this Province.'"
This act allows the provincial sheriffs to seize and sell the non-exempt property of debtors once a guilty verdict has been passed by a judge in court proceedings.
