An Act to alter and amend an Act passed in the first year of Her Majesty's reign, entitled, “An Act to protect the Inhabitants of this Province, against lawless aggressions from Subjects of Foreign Countries at peace with Her Majesty.” Passed 10th February, 1840. 3 Victoria – Chapter 12 1840 This is an amendment to an act first passed in 1838, which makes it possible for the lieutenant governor to assemble the militia to defend the province in cases where foreign nations who do not currently have a peace agreement with Britain commit acts of aggression against the province. The amendments primarily concern the form of punishments for those convicted of treason in these cases, and prescribe capital punishment for those found guilty of treasonous acts (or felony in cases of foreign non-subjects participating in acts of aggression within the province while their home country is at peace with Britain).
